Terms of Service

Using Kokoro products and services constitutes client’s acceptance of Kokoro’s Terms of Service as follows:

Working Together

Confidentiality

We care about your privacy. Kokoro does not share email lists or clients’ lists. Both parties agree to keep private all financials and trade secrets, whether verbal or written, that they may gather by virtue of this agreement and working together.

Data Management

Kokoro uses industry-standard best practices when handling your data. Your company is responsible for its data including email lists, personal data of its customers, for any data compliance requirements, and for having its own data lead or data protection officer. Kokoro does not warrant the compliance of your company’s data practices, security, or compliance.

Payment Methods

Kokoro accepts payments via credit/debit card and Paypal. Payment by any other means, such as check or wire transfer, is on a per-customer basis and must be agreed to by Kokoro.

Monthly and Subscription Billing, Single Item Purchases

Invoices are generated and payments are collected at the beginning of each billing period. Customer billing periods typically begin on the day of the month in which clients purchase services and/or subscriptions. When you purchase a block of time (e.g. 5-hour block of time) or other session, the time needs to be used within 30 days of purchase; it’s up to you to schedule your time with us, plan to schedule a minimum of 48 hours in advance; our calendar fills up and sometimes we are a week+ out on availability. Missed sessions are billed at the full rate. 24-hour notice is required for rescheduling a session you have booked with us.

Approvals

If your project requires you to approve anything, including copy, you have 7 days from the date you receive it to approve or provide edits back to us. After 7 days we’ll move forward and assume it’s approved.

Canceling

If you need to cancel, call us.

Ongoing monthly agreements or subscriptions remain operative until terminated by either party by giving both 1) 30 days notice in writing, and 2) a verbal request with a Kokoro staff member. A conversation with a Kokoro staff member is required to create a cancellation request. Just sending an email request to cancel does not constitute acceptance of any cancellation. Customers are encouraged to keep records of all cancellation communication.

5-hour block of time subscriptions are a 3-month minimum and require 30-day notification of cancellation.

Closing an account with Kokoro cannot be done by simply canceling the credit/debit card. Kokoro will continue to treat this as an open account and the billing cycle will continue, resulting in a past-due account that may be turned over to a third-party collection service. It is imperative that account cancellation is done by speaking with a staff member at Kokoro to ensure account closure.

Cancellation of an account does not dismiss outstanding invoices. At the time of cancellation, any outstanding balance must be settled. All cancelled accounts with an outstanding balance may be automatically turned over to a third-party collection service.

Credits

If you buy something from Kokoro where we specify that the price of that item can be credited toward future services (for example the Kokoro Discovery Project), that credit is good for 60 days from the date the funds were paid.

Refunds

Kokoro does not issue refunds for services unless previously specified in writing. If for some reason the scope of work needs to be changed from the original plan, a new Statement of Work will be agreed upon and signed by both parties.

We do promise a money-back guarantee for the 7 Marketing Basic Course (including Webinar Wiz, Social Media Basics, White Paper and Guide); if participated in your first module, did the work, but didn’t think it was worth it, you can call us within 2 weeks and we’ll cheerfully and promptly send you refund.

Limitation of Liability

In no event shall either party’s liability under this agreement exceed the amount paid by your company to Kokoro during the period of this agreement. Check with your company attorney for data compliance questions and advice, and GDPR requirements.

Governing Law

Any disputes or differences arriving out of this agreement will be amicably settled through the joint conciliatory efforts of both the parties, or mediation, or binding arbitration. This agreement shall be governed by the laws of the State of California and in Nevada County, California, USA. These terms can be updated at any time without notice.
